Missing just one paycheck or even an hour of work will threaten the migrant workers’ ability to maintain a safe shelter, adequate food and decent clothing. Without recognizing and advocating for their rights, migrant workers often make less than one dollar per hour.

Upholding migrants’ basic human needs is directly tied to their wages, so maintaining adequate and fair wages is crucial.

Migrant Legal Aid is a great resource for securing equal treatment under federal and state law.

Migrant Legal Aid helps explain and enforce The Fair Labor Standards Act and the Migrant and Seasonal Agriculture Worker Protection Act. These were created to help migrants maintain their income by protecting the standards of minimum wage, overtime pay, record-keeping, and youth employment. These standards apply for all workers, even those who earn their wages by piece rate.

Minimum Wage in Michigan​

As of March 29, 2019, the minimum wage is $9.45 per hour. The Public Act 337 of 2018 established annual increases of the minimum wage. However, the increase in minimum hourly wage does not take effect if the unemployment rate for Michigan is 8.5% or greater throughout the prior year.

Fair Labor Standards Act

Migrant Legal Aid helps to explain and enforce the rights of migrant workers, such as those granted by The Fair Labor Standards Act. This act grants individuals the right to a minimum wage and overtime pay, and it protects the standards of record-keeping and youth employment. These standards apply for all workers, even those who earn their wages by piece rate, as migrant farm workers often do.

Migrant and Seasonal Agriculture Worker Protection Act

Along with job site condition requirements, this act requires that also requires that migrant workers be given the terms and conditions of their work in writing.
